Terms & Conditions

When purchasing and/or use of a ticket, and/or entering into our venues, Stavkroa (Afterski, Nightclub, Kitchen Bar, Stallen or Rock Bar) you agree to these Terms and Conditions without modification, and you enter into a binding contract with us in Hemsedal Café AS / PoeX AS.

By purchasing a ticket or entering our venues, you acknowledge and agree to follow all participating venue’s terms, conditions, and discretionary safety protocols, including but not limited to, social distancing guidelines and mask guidelines.

When entering Stavkroa you agree to our code of conduct. We are dedicated to make our venues and events a safe place for all. You shall not:

is threatening, libelous, defamatory, or obscene;

would constitute a criminal offense, give rise to civil liability, or otherwise violate law in any manner;

infringes the intellectual property, privacy, or other rights of any third parties; or

constitutes or contains false or misleading statements.

Behavior that adversely affects any other party’s enjoyment at the venues and events or is determined by the staff at the venues/events to be unsafe, illegal, or inappropriate, will result in ejection from the venues and events with no refund. If you fail to comply with such terms and conditions, you will be removed from the venues/events site, and, if necessary, venues/events staff may call on the police for assistance.

You consent also not to hack or use our infrastructure for unethical, illegal or malicious activities. The staff at our venues and events may at any time, with or without giving notice, reserve the right to refuse entry to guest, right to refuse serving alcohol to any guests, and show people out off the property, no matter the reason and without refunding your ticket. Examples of reasons are disrespect towards our staff, disrespect towards other guests, excessively intoxicated, the use, selling and suspicion of any involvement with illegal drugs and violence, among other things.

Honestly, all we ask for is that you be nice and listen to our staff. They are sober and you are most likely very drunk and having the time of your life. If you do this, you can come back any time.

It may be necessary to change our events, content and timing of our program. By this contract you agree that Stavkroa or any participating venues reserves the right to change, modify, or alter any aspect of the events (including, without limitation, the event schedule, the location of the events, the appearance of any performer or artists, and/or the order of performance of any performer or artist), at any time, for any reason whatsoever, without any prior notice or compensation to you. You understand that the artists and/or lineup for our events may be changed and that such occurrence shall not, under any circumstances, entitle you to any claim whatsoever, including, but not limited to, a refund of your ticket.

You agree and that your registration for our events, table bookings and/or group bookings is subject to our confirmation that will be sent to you via email. We are entitled to deny your registration without cause.

EXCEPT AS EXPLICITLY OTHERWISE PROVIDED HEREIN, YOU UNCONDITIONALLY UNDERSTAND THAT ALL TICKET SALES ARE FINAL. The Norwegian Right of Cancellation Law( angrerettsloven) does not apply to the purchase of a ticket.

Tickets/tables can’t be privately resold.

The Hosting Organisation may at any time, with or without giving notice, in its absolute discretion and without giving any reason, cancel your registration and/or cancel or postpone their events, whether physical or virtual, change its venue or any of the other published particulars, or withdraw any invitation to attend. In case of cancellation of your registration by the Hosting Organisation and/or cancellation of the events by the Hosting Organisation, the paid event fees will be reimbursed to you in due time subject however to the provisions futher down. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In case of postponement of the events, the paid event fees (if any) will not be refunded by the Hosting Organisation. Should the events be postponed or cancelled, we are not responsible nor liable for any costs and/or expenses you may incur due to the postponement and/or cancellation of the events.

The Hosting Organisation will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under these Terms that is caused by events outside its reasonable control and in such circumstances the Host Organisation may not reimburse any paid events fees. By this we mean any event which is beyond our and/or your reasonable control, including but not limited to, Act of God, fire, flood, lightening, storm, earthquake or other climatic or meteorological catastrophes, failure or delay of common carrier or impairment or lack of adequate transportation facilities, accident or repair to machinery, act of sabotage including but not limited to piracy or hacking, embargo, government requirement or action including the imposition of sanctions by any country against Norway or a country in which a party is registered or a country in which the Venues/Events is deemed to be staged, war, civil or military authority, terrorism and industrial dispute, strike or labour disturbance, regulatory change or change in law, or any event or circumstance which puts at risk or endangers the health, safety or security of our and/or your personnel, which prevents and/or affects the performance of these Terms and/or the staging of our events, and could not have been prevented, avoided or remedied by the party affected by the party not able to perform, taking reasonable precautions (“Force . Performance under these Terms is deemed to be suspended for the period that the Force Majeure event continues to affect performance. We and/or you will use our reasonable endeavours to bring the Force Majeure event to a close or to find a solution by which our and/or your obligations under these Terms may be performed despite the Force Majeure event.

Tickets/tables can’t be privately resold. Due to security and ID checks, we do not issue tickets to anyone other that the person who bought the ticket. When buying a ticket you agree that you won’t resell the tickets. Our venues and events will not honor tickets sold by 3rd parties or scalpers, we will NOT service, support or honor any tickets obtained from any other source. The only valid tickets are those purchased and/or redeemed through our website: www.stavkroa.com.

Each ticket holder must be present when entering. An individual will not be able to enter with if the ticket holders are not present. When buying a tickets for a larger group the ticketholder need to be present when the group is entering. If the ticketholder is sick, please contact us on: stavkroa@gohemsedal.no so we can change the name of the ticketholder. Changing the ticketholder is a service we only serve to larger groups, and they need to get in touch with us before the day entering our venues.

If your ticket/table has an arrival time on it, late arrival will result in no longer guaranteed entry to Stavkroa and Stavkroa can resell your table/ticket. Please bring a Photo I.D. Photocopy of I.D. or photocopy of tickets are not accepted. Fake IDs will be taken and refusal of entry.

Entry is limited to to persons that meet the venues minimum age requirements. You must be at least twenty (20) years of age or older. No exceptions will be made, even if you are accompanied by an adult or a person with valid identification. Failure to provide valid identification shall preclude you from entering our venues and you shall not be entitled to any refund, nor will Hemsedal Cafe AS be liable for, any other damages, including, but not limited to, incidental and/or consequential damages. In addition, during our events, you must be able to provide valid identification if requested by Stavkroa´s staff. If you are unable to show a valid identification, you may be promptly ejected from our venues without the opportunity to return, and you shall not receive a refund of your ticket.

The following original forms of identification are acceptable: valid state-issued driver’s license; valid passport; Visa with a picture, International ID card, state-issued temporary [paper] ID. Electronic ID is not accepted.

Prohibited items include, but are not limited to the following items: weapons of any kind, alcohol, metal cans, laser pointers, audio recording equipment, professional still/video camera equipment, items intended for sale or promotion, glass containers, selfie sticks, coolers, drones, backpacks, oversized bags (larger than 16”X16”X18”), clothing with offensive or profane language, firearms with exception of retired and off-duty officers with proper credentials, and any other items that can be used as a means to disturb the peace or is deemed as a threat to the health and safety of attendees. Management of participating venues reserves the right to inspect and/or search all persons, packages, and bags entering their premises.

Smoking is only allowed outside in designated areas.

Entering our venues you understand, agree, and acknowledge that (1) you may be photographed and filmed, and (2) you hereby provide Hemsedal Café AS / Poex AS (Stavkroa) with your absolute, express consent to be photographed and filmed. You further understand and agree that these images and/or recordings can be registered, stored, transmitted, broadcast/streamed, rebroadcast, and sold for archival, promotional, and/or commercial purposes, in any manner, and in any media, now known or hereafter discovered, without any compensation to you. Your name, image, and/or your likeness may be captured as part of and/or used in connection with any broadcast/stream, audio, visual, or audio-visual recording, photograph, or other reproduction or other publication of the event, venues and the the Hosting Organisation (the “Footage”) and may also be used by or on behalf of Hemsedal Cafe AS / Poex AS or any of Hemsedal Cafe AS parent entities, subsidiaries, affiliates, partners, sponsors, officers, shareholders, successors, licensees or assigns for any purpose, including, , but not limited to, archival, promotional, and commercial purposes, without any compensation to you. You waive all other rights in and to the Footage, including, but not limited to, all claims of so-called moral rights. This Footage may be used as a means to identify and facilitate the prosecution of illegal or impermissible conduct.

If you don’t consent to our usage of photos and recordings (described over), you understand, agree, and acknowledge that you must contact us before entering our venues at: stavkroa@gohemsedal.com and at the entrence of our venues. You also agree to get a mark of any kind (ex. mark with a pen on your forehead).

By entering the Event, you assume any and all risk and/or danger, known and unknown, foreseeable and unforeseeable, resulting from, or incidental to, the venues and/or events, whether occurring prior to, during, or subsequent to, any events at our venues, including, but not limited to, any death, personal injury or loss, damage or liability whatsoever. Your presence at the venue, whether occurring prior to, during or after the events, including, but not limited to, any actions or omission of the venue.

You hereby indemnify and hold harmless Hemsedal Cafe AS, their parent, affiliate, and subsidiary companies, and each of their respective representative, officers, directors, owners, members, trustees, agents, employees, successors, licensees and assigns, designated ticketing agent, venues and events sponsor/promoter, and the performing artists, including, but not limited to, their respective management, their agents, their staff, and their designees (collectively referred to as “the Hosting Organistation Parties”) from any loss, liability, damage or cost in any way arising out of, or related to, your actions and omissions at, around, or while participating in our events.

You hereby waive, discharge, hold harmless, and covenant not to sue the Hosting Organisation and venue from any and all liability arising out of, or in connection with, the venue and events, for any claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs or expenses of whatsoever kind, nature, or description, whether direct or indirect, in law or in equity, in contract or in tort, or otherwise, whether known or unknown, arising out of, or related to, our venues, your attendance at our venues, your travel to and from our venues, except to the extent caused by the gross negligence or willful misconduct of the Hosting Organization Parties.

In no events will the venue and the Hosting Organisation Parties or their suppliers, advertisers, and sponsors, be responsible or liable to you or anyone else for, and you hereby knowingly and expressly waive all rights to seek, direct, indirect incidental, special, punitive, or consequential damages or lost profit, revenues, or other damages of any type, and any rights to have damages multiplied or otherwise increased, arising out of, or in connection with the venue or Hosting Organisation or any product or service purchased at our venue or homepage: www.stavkroa.com, even is the venue and/or the Hosting Organisation Parties have been advised of the possibility of such damages, and regardless of whether the claim is based upon any contract, tort, or other leagal responsibility whatsoever for (a) any failure of another attendee of the venues or events, to confirme these rules (b) personal injury or property damage of any nature whatsoever, whether arising in contract or in tort, resulting form your attendance at our venues and events (c)

Any errors, mistakes, inaccuracies omissions in any content, or (d) any lost, stolen, or damaged tichets, or failure of the venue and events staff or security to honor your ticket. Your sole and exclusive remedy for dissatisfaction with the venues or events is to leave our venues or events. The limitations in these paragraph will apply even if any limited remedy fails its essentials purpose. The allocation of risk between the parties is an essential element of the basis of the bargain between us. Some jurisdictions do not aloe the exclusion or limitations of damages, so there may not apply to you. In such cases, the the venues or/and the Hosting Organisation Parties liability will be limited to the fullest extent permittet by law. You acknowledge and agree that by purchasing tickets or by entering our venues and regardless if such exclusions or limitations apply, in no event will attorneys fees be awarded or recoverable by you.

In no event shall the venues or/and the Hosting Organisation Parties be liable for any claim unless written notice is given within six (6) months from the date of the loss. No suit for any cause may be maintained against the venues or the Hosting Organisations Parties unless it is commenced within one (1) year after the event.

You hereby acknowledge and agree that anu dispute is likely to involve complicated and difficult issues, and therefore, you knowingly, voluntarily, intentionally, irrevocably, and unconditionally waive any right you may have to a trial by jury in respect of any dispute or conflict in connection with this agreement.

You unconditionally agree that the terms and conditions contained herein and/or referenced herein represent the entire agreement between you and Hemsedal Cafe AS and Poex AS with respect to its subject matter, and shall supersede and replace all prior contemporaneous understandings, communications, and agreements, written or oral, regarding such subject matter which contradict these terms, including, but not limited to, the text contained on the back of the actual ticket and/or any contrary understanding or agreements between you and Hemsedal Cafe AS and Poex AS. You further confirm that there are no other agreements between you and any of the other venue and the Hosting Organisation Parties. You unconditionally agree to be bound by any and all of the terms and conditions contained herein and/or referenced herein and any additions, changes and/or modifications thereof, which may be made from time to time without prior notice to you. Any updates to our new terms and conditions will be posted to this website address.

If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible so as to effect the intent of the parties hereto, and the other provisions contained herein will remain in full force and effect. The company’s failure to insist upon or enforce any provision of this Agreement shall not be construed as a waiver of any provision or right.

Disobeying or disagreeing with our rules, can result in a permanent ban from our venues and events. If there is a violation of Norwegian law, then this will be reported to the police.
